LEGAL NOTICE

2. Purpose and Nature of the Services

Born to the Ocean provides the following services:

• Specialized guidance on dive destinations

• Curation and design of group experiences

• Logistical coordination between participants and local providers

• Group supervision and accompaniment when applicable

• Online training and digital content

• Sale of digital products and merchandise

Born to the Ocean does not act as a travel agency nor as an organizer of package travel within the meaning of Directive (EU) 2015/2302.

The company does not market integrated travel packages nor assume the status of direct provider of regulated tourism services.

3. Contractual Structure of Travel Experiences

3.1 Services Provided by Born to the Ocean

Born to the Ocean receives fees exclusively for:

• Design and planning of the experience

• Coordination with local providers

• Group management

• Pre-trip guidance and support

These fees constitute an independent service.

3.2 Services Provided by Third Parties

Specific tourism services, including but not limited to:

• Accommodation

• Diving activities

• Local transportation

• Maritime operations

• Other tourism services

Are provided directly by duly authorized local providers.

The contracting of such services is carried out directly between the user and the corresponding provider, under their own terms and conditions.

Born to the Ocean does not intervene in the invoicing nor in the direct provision of such services.

4. Payments and Invoicing

• Born to the Ocean’s fees are paid directly to the company.

• Local tourism services are paid directly to the respective providers.

• There is no single global price integrating third-party services and coordination fees.

Each contractual relationship is independent.

5. Liability

Born to the Ocean is solely responsible for the proper delivery of its guidance and coordination services.

It shall not be liable for:

• Breach of obligations by local providers

• Cancellations, modifications, or alterations of tourism services

• Accidents or incidents occurring during activities managed by third parties

• Personal decisions made by the user regarding flights or other services not coordinated

Responsibility for the execution of tourism services lies exclusively with the provider delivering such services.

6. Inherent Risks of Diving Activities

The user acknowledges that diving involves inherent risks.

It is the participant’s responsibility to:

• Hold valid certification

• Maintain adequate dive insurance

• Comply with local provider regulations

• Declare relevant medical conditions

Born to the Ocean does not conduct medical evaluations nor issue technical certifications.

7. Cancellations and Modifications

7.1 Born to the Ocean Fees

Cancellation conditions for coordination fees will be specified for each specific experience.

7.2 Third-Party Services

Cancellation conditions for accommodation, diving, or other services are exclusively subject to the policies of the corresponding provider.

8. Limitation of Liability

Under no circumstances shall Born to the Ocean be liable for:

• Indirect losses

• Consequential damages

• Loss of profits

• Loss of flights

• Changes in immigration regulations

• Force majeure

9. Intellectual Property

All website content (texts, photographs, videos, designs, educational materials) is the property of Born to the Ocean or its legitimate owners.

Reproduction without express authorization is strictly prohibited.

10. Data Protection

The processing of personal data is governed by Regulation (EU) 2016/679 (GDPR) and applicable Estonian legislation.

Data is used exclusively for the management of contracted services and will not be shared with third parties except where legally required or operationally necessary for the contracted experience.

11. Applicable Law and Jurisdiction

The contractual relationship between the user and Born to the Ocean OÜ shall be governed by the laws of the Republic of Estonia and applicable European regulations.

Without prejudice to any rights that may correspond to consumers under the laws of their country of residence.
